MURDER ON THE DECKS®

Murder On The Decks® ("we," "us," "our") is committed to delivering high-quality, limited-edition products. Each item undergoes meticulous inspection to ensure it meets our exacting standards before dispatch. However, due to the exclusive, made-to-order nature of our products, the following Terms & Conditions (T&Cs) govern all returns, refunds, and exchanges, subject to your rights under Australian Consumer Law (ACL).
1. LIMITED EDITION & EXCLUSIVE DROPS
1.1 Made-to-Order Products
All products offered by Murder On The Decks® are produced in limited quantities and are made-to-order. As a result, all sales are final except where the product is faulty, defective, or significantly different from its description. We do not accept returns, exchanges, or refunds for the following:

Change of mind or buyer’s remorse

Incorrect sizing selected by the customer

Accidental, duplicate, or incorrect orders

Incorrect shipping information provided by the customer
1.2 Non-Returnable, Non-Refundable Items
By agreeing to these T&Cs, you acknowledge that, due to the made-to-order nature of our products, no returns or exchanges will be accepted unless the item is defective, misdescribed, or fails to comply with ACL consumer guarantees.
1.3 Consumer Rights Under Australian Consumer Law
Nothing in this policy overrides your rights under Australian Consumer Law (ACL). If your product is found to be faulty, defective, or misdescribed, you are entitled to remedies under ACL, irrespective of the product's exclusivity or made-to-order status.
2. DAMAGED, DEFECTIVE, MISPRINTED, OR INCORRECT ITEMS
2.1 Notification of Claims
If your item arrives damaged, defective, misprinted, or incorrect, you must notify us in writing within 48 hours of receiving the item. Claims submitted after this period will be considered on a case-by-case basis and may be denied.
2.2 Claims Process
To initiate a claim, please follow these steps:

Provide clear photographs of the item, including the packaging and defect.

Submit a detailed written explanation of the issue.
2.3 Remedies Under Australian Consumer Law
If we confirm that the product is faulty, defective, or misdescribed, we will, at our sole discretion and in accordance with ACL, offer one of the following remedies:

A full refund to your original payment method, or
-
A replacement item, produced and shipped at no additional cost.
2.4 Verification of the Issue
We will conduct a thorough investigation of your claim. Replacements or refunds will only be processed once we have verified the issue. We reserve the right to refuse replacement or refund if the defect or issue is not substantiated.
2.5 ACL Compliance Reminder
Our remedies are provided in full compliance with Australian Consumer Law. These remedies will not be withheld due to the limited-edition or made-to-order nature of the product. You are entitled to a remedy for defective or misdescribed products under ACL, regardless of our policy.
3. EXCLUSIONS & NON-REFUNDABLE ITEMS
3.1 Exclusions
We do not accept returns or offer refunds for:

Change of mind or buyer’s remorse

Incorrect sizing selected by the customer

Normal wear and tear after delivery

Delivery delays or issues caused by third-party couriers or postal services

Items returned without prior approval

Incorrect or incomplete addresses provided at checkout

Sale items and gift cards (non-refundable)
3.2 ACL Compliance Reminder
These exclusions are strictly limited to change-of-mind scenarios. They do not override your statutory rights under Australian Consumer Law. If an item is defective, misdescribed, or not as expected, you are entitled to a remedy under ACL, even for items marked as non-returnable.
4. EU CUSTOMERS – 14-DAY COOLING-OFF PERIOD
4.1 Cooling-Off Period
For customers in the European Union, you are entitled to a 14-day cooling-off period under EU consumer protection laws. You may cancel or return an order within 14 days of receiving the item, subject to the conditions outlined below.
4.2 Eligibility for Return
To qualify for a return, the following conditions must be met:

The item must be unused, unworn, and in its original, unaltered condition.

All tags and packaging must remain intact.

Proof of purchase is required.
4.3 Exceptions to Cooling-Off Period
Custom-made, print-on-demand, or personalized items may not be eligible for return under EU regulations, unless they are faulty, defective, or misdescribed.
5. REFUND PROCESSING
5.1 Refund Approval
Once your return or claim is reviewed, we will notify you of the outcome. If your claim is approved, the refund will be processed.
5.2 Refund Timeline
Refunds will be processed within 10 business days of approval. Please note that bank processing times may vary, and additional time may be required before the funds appear in your account.
5.3 Missing Refunds
If you have not received your refund within 15 business days, please contact us via contact@murderonthedecks.com for assistance.
5.4 ACL Compliance Reminder
All refunds for faulty, defective, or misdescribed products will be processed in full compliance with Australian Consumer Law, which guarantees a remedy in the case of a product that fails to meet the statutory requirements.

Murder On The Decks® is dedicated to providing the highest quality products. If your product does not meet our standards, we will review your concern with respect, fairness, and integrity to ensure a satisfactory resolution.
6.2 ACL Rights Reminder
Regardless of the nature of the product, you retain your rights under Australian Consumer Law. We will always comply with ACL guarantees and ensure that a remedy is provided for faulty, defective, or misdescribed products.
7. UPDATES & FUTURE ACL COMPLIANCE
7.1 Policy Updates
We reserve the right to amend this Returns & Refund Policy at any time to reflect changes in Australian Consumer Law or business practices. Any amendments will be effective immediately, and we will take reasonable steps to notify you of significant changes. Continued use of our services after policy updates constitutes your acceptance of the revised terms.
8. AGREEMENT
By placing an order with Murder On The Decks®, you acknowledge and agree to the Terms & Conditions set forth in this Returns & Refund Policy. Your rights under Australian Consumer Law always take precedence over any terms outlined herein. Should there be any conflict between this policy and ACL, ACL will apply.
9. LIMITATION OF LIABILITY
9.1 Total Liability
To the fullest extent permitted by law, Murder On The Decks®’ total liability for any claim arising out of or in connection with a product or service shall not exceed the amount paid for the product in question, excluding any applicable taxes, shipping, or handling charges.
9.2 Exclusion of Certain Damages
We will not be liable for any indirect, incidental, special, or consequential damages arising from any claim, including but not limited to loss of profit, revenue, data, or goodwill, regardless of the form of the claim, whether based in contract, tort, negligence, or any other legal theory, unless such damages are directly caused by a defect or failure under Australian Consumer Law (ACL).
10. EXCLUSION OF CERTAIN DAMAGES
10.1 Exclusion of Liability for Losses
Under no circumstances will Murder On The Decks® be liable for any consequential, incidental, or special damages, including but not limited to loss of profit, loss of data, or any form of personal injury, unless caused directly by a defect in the product that is subject to ACL guarantees.
10.2 ACL Compliance
This exclusion applies only to damages not caused directly by a defect or failure under the Australian Consumer Law (ACL). Our liability under ACL remains unaffected, and any exclusions stated herein shall not limit the remedies available to consumers for faulty or misdescribed products.
11. FORCE MAJEURE
11.1 Non-Liability for Unforeseeable Events
Murder On The Decks® will not be held liable for any failure to deliver or perform any obligation under this policy where the failure arises from causes beyond our reasonable control, including but not limited to acts of God, war, strikes, supply chain disruptions, pandemics, or any other force majeure event that disrupts the ability to fulfill orders.
11.2 Reasonable Efforts to Fulfill Obligations
In the event of such an occurrence, we will make all reasonable efforts to mitigate the effects of such events and fulfill our obligations as soon as possible. However, we are not responsible for delays, non-performance, or failure to deliver beyond our reasonable control, including those arising from national or global disruptions.
12. DISCLAIMER OF UNINTENTIONAL ERRORS
12.1 Accuracy Disclaimer
While we strive for accuracy in all our product descriptions, pricing, and promotional materials, Murder On The Decks® does not guarantee the accuracy of any information provided.
12.2 Right to Correct Errors
We reserve the right to correct errors, including in pricing, descriptions, availability, and order details. We may also cancel or modify orders placed with incorrect information or due to system errors.
12.3 Refund in Case of Error
In the event of such an error, we will provide a full refund to the original payment method if the order is canceled before shipment.
13. RIGHT TO REFUSE SERVICE
13.1 Refusal of Service
Murder On The Decks® reserves the right to refuse service, cancel orders, or refuse to process any claim if we determine, at our sole discretion, that a customer has engaged in fraudulent, abusive, or disruptive behavior.
13.2 Violation of Terms
We may also refuse service to customers who have violated any of the terms outlined in these Returns & Refund Policies, or engaged in activities that undermine the integrity of our business operations.
14. BURDEN OF PROOF
14.1 Customer Responsibility
The customer shall bear the burden of proof in all claims related to the defect, damage, or misdescription of a product. In order for a claim to be processed, the customer must provide sufficient evidence (e.g., photographs, videos) demonstrating that the item is defective, damaged, or does not meet the description provided at the time of purchase.
15. NO THIRD-PARTY LIABILITY
15.1 Third-Party Services
Murder On The Decks® is not responsible for any claims, defects, damages, or issues that arise due to third-party services, resellers, or distribution channels.
15.2 Direct Claims Only
All claims for defective or misdescribed products must be submitted directly to Murder On The Decks®, and we are not liable for issues arising from third-party intermediaries or external services.
16. BINDING ARBITRATION
16.1 Arbitration Agreement
Any dispute or claim arising out of or relating to these Returns & Refunds Terms and Conditions, including but not limited to claims of breach or enforcement, shall be resolved through binding arbitration, in accordance with the rules of the Australian Centre for International Commercial Arbitration (ACICA).
16.2 Finality of Arbitration
The decision of the arbitrator shall be final and binding on all parties, and any arbitration award may be enforced in any court of competent jurisdiction.
17. JURISDICTION AND VENUE
17.1 Governing Law
This policy and any disputes arising hereunder shall be governed by the laws of South Australia, Australia.
17.2 Exclusive Jurisdiction
Any claims or disputes that cannot be resolved through arbitration will be brought before the courts of South Australia, which shall have exclusive jurisdiction over any such matter.
18. INDEMNIFICATION
18.1 Indemnity Obligation
You agree to indemnify, defend, and hold harmless Murder On The Decks®, its officers, employees, agents, and affiliates from any and all claims, losses, damages, liabilities, or expenses (including legal fees) arising out of your breach of these Terms, your use of our products, or any third-party claims related to your actions.
18.2 Scope of Indemnity
This indemnity includes, but is not limited to, any legal costs and expenses incurred in defending a claim, and extends to any harm or damage caused to Murder On The Decks®’ business interests, reputation, and operations.
