Welcome to Murder On The Decks® (“we”, “us”, “our”). These Terms of Service (“Terms”) govern your use of our website, online store, products, and services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy.

You are solely responsible for maintaining the security and confidentiality of your account and all activity under it.
1.3 Account Transfer & Single Account Policy
Accounts may not be transferred, sold, assigned, or licensed without our prior written consent. Each customer may maintain only one account. Multiple accounts for the purpose of exploiting promotions, discounts, purchase limits, or any other benefit are prohibited and may result in cancellation of orders and legal action.
2. Products & ACL Compliance
2.1 Product Descriptions
We strive for accuracy in product descriptions and images; however, colors and appearance may vary with device or monitor settings.
2.2 Availability
Products are made-to-order or limited edition. Availability may change without notice.
2.3 ACL Rights
Nothing in these Terms limits your statutory rights under the Australian Consumer Law (ACL). You retain all rights to repair, replacement, or refund for faulty, defective, or misdescribed products. Attempts to rely on other clauses to override ACL rights are void and unenforceable.
3. Orders
3.1 Order Acceptance
Placing an order constitutes an offer to purchase. Orders are only accepted once payment is confirmed.
3.2 Order Modification & Cancellation
We may decline, modify, or cancel any order at our discretion.
3.3 Made-to-Order Products
Orders for made-to-order or personalised products may not be canceled once processing begins. ACL rights for faulty, defective, or misdescribed products remain unaffected.
3.4 ACL Reminder
Your ACL rights apply to all orders, including made-to-order or limited edition products. Any attempt to lodge a dispute or chargeback for non-ACL reasons is considered fraudulent.
4. Pricing & Billing
4.1 Price Changes
Prices, discounts, and promotions may change without notice.
4.2 Price at Time of Order
The price charged is that applicable at order acceptance.
4.3 Billing Information
You must provide accurate, complete, and current payment and billing information, updating it promptly as needed.
4.4 ACL Reminder
ACL rights for faulty, defective, or misdescribed goods remain intact regardless of price changes.
4.5 Chargeback / Payment Abuse
You may not initiate a chargeback, reverse a payment, or dispute a transaction except for legitimate ACL claims. Any attempt to circumvent this may result in liability for the full cost of goods, legal fees, and associated damages.
5. Shipping & Delivery
5.1 Shipping Timeframes
Shipping estimates are indicative only and may be affected by courier issues, customs, weather, or other events beyond our control.
5.2 Ownership and Risk
Ownership and risk pass to you upon dispatch.
5.3 Customer Responsibility
You are responsible for accurate shipping details. We are not liable for delays caused by incorrect or incomplete information.
5.4 ACL Reminder
Your ACL rights apply regardless of shipping delays or transfer of risk.
6. Intellectual Property
6.1 Ownership
All trademarks, designs, logos, content, and other intellectual property related to the Services are owned by Murder On The Decks®, its affiliates, or licensors.
6.2 Limited Use & Commercial Prohibition
You may only use our Services for personal, non-commercial purposes. Unauthorized resale, redistribution, or commercial use without consent is prohibited and may result in civil or criminal liability.
6.3 IP Enforcement
Violations of our intellectual property rights may result in civil and criminal prosecution.
7. Optional Tools & Third-Party Links
7.1 Third-Party Tools
We may provide access to third-party tools or links. They are provided “as is” and at your risk.
7.2 No Endorsement
We do not monitor, endorse, or guarantee third-party tools.
7.3 ACL Reminder
ACL rights for purchased products remain intact regardless of third-party tools or links.
8. Shopify Relationship

Our Services are powered by Shopify. All sales are directly with Murder On The Decks®.
8.2 Shopify Disclaimers
Shopify is not responsible for products, services, or disputes arising from your purchases.
9. Feedback
9.1 Grant of License
By submitting feedback, you grant us a perpetual, worldwide, royalty-free license to use, modify, and publish it.
9.2 Responsibility
You represent that feedback does not infringe third-party rights and is not unlawful, defamatory, or malicious.
10. Errors & Inaccuracies

We may correct typographical errors, pricing mistakes, or inaccurate information at any time.
10.2 ACL Reminder
ACL rights for faulty, defective, or misdescribed products remain unaffected by errors or inaccuracies.
11. Prohibited Uses
11.1 Lawful Use
You must use Services lawfully. Harassment, spam, malware transmission, or intellectual property infringement is prohibited.
11.2 Automated / Bot / Scraper Prohibition
Use of automated scripts, bots, scraping software, or any technology to bypass purchase limits, collect data, or manipulate orders is strictly prohibited. Such actions constitute unlawful interference and may result in civil and criminal prosecution.
11.3 Consequences
Violations may result in suspension, termination, and legal action.
12. Termination
12.1 Termination Rights
We may suspend or terminate access at any time, for any reason, without notice.
12.2 Survival of Provisions
Provisions relating to Intellectual Property, Feedback, ACL rights, anti-fraud, and Limitation of Liability survive termination.
13. Disclaimers & Limitation of Liability
13.1 As-Is Basis
Services and products are provided “as is” and “as available” without warranties.
13.2 Exclusions
Except as required by ACL, we disclaim all warranties, including implied warranties of merchantability, fitness for purpose, or non-infringement.
13.3 Limitation of Liability
We are not liable for indirect, incidental, or consequential damages arising from your use.
13.4 ACL Reminder
Nothing in this section excludes, restricts, or modifies your ACL statutory rights.
14. Anti-Exploitation / Abuse
14.1 Refund & Cancellation Abuse
Change-of-mind cancellations or refund claims for made-to-order, personalised, or limited edition products are prohibited. ACL rights for faulty, defective, or misdescribed goods remain intact.
14.2 Promotion / Coupon Abuse
Misuse of promotions, coupons, discounts, or bulk deals—including multi-account exploitation—may result in voided orders and legal action.
14.3 Resale & Commercial Use
Products are for personal use only. Unauthorized resale or commercial use without written consent is prohibited and may incur civil or criminal liability.
14.4 Chargeback / Payment Abuse
Fraudulent chargebacks, payment reversals, or disputed transactions outside ACL claims will result in liability for the full cost of goods, legal fees, and associated damages.
15. Indemnification
You agree to indemnify, defend, and hold harmless Murder On The Decks®, its affiliates, employees, and Shopify from all claims, damages, losses, or costs arising from your breach, unlawful use, or fraudulent activity, including automated abuse, multi-account exploitation, promotion misuse, chargeback abuse, or resale of products.
16. Monitoring & Enforcement
We reserve the right to monitor, audit, and investigate accounts for suspicious or abusive activity. You consent to such monitoring as a condition of using the Services. Orders may be canceled or accounts suspended for detected abuse or fraud.
17. Severability & Waiver
17.1 Severability
If any provision is unenforceable, it is severed. Remaining provisions remain in full effect.
17.2 Waiver
Failure to enforce any provision is not a waiver of that or any other provision.
18. Governing Law & Jurisdiction
18.1 Jurisdiction
These Terms are governed by the laws of South Australia and the Commonwealth of Australia.
18.2 Exclusive Jurisdiction
You submit to the exclusive jurisdiction of courts in Adelaide, South Australia.
18.3 Global Customers
For international customers, local statutory rights apply only to the extent enforceable. These Terms otherwise govern, and any attempt to invoke foreign consumer laws to override these Terms is void.
19. Changes to Terms
We may update these Terms at any time. Continued use after updates constitutes acceptance of the revised Terms.
